1. Scope of Services

Website Build

Inclusions:

• Custom website built based on the details outlined at the time of sign-up.

• The number of website pages and revisions as per the selected hosting plan (see Section 3).

• Copywriting included for all pages (content created by The Agency).

• Logo design and colour consultation included in Silver and Gold plans (1 revision).
  Available for Bronze plan at an additional cost.

• SEO report provided upon completion of the website.

Ownership:
All website content and design remain the property of The Agency unless a separate written agreement for ownership transfer is made.

2. Timeline

• The initial website draft will be delivered within 10-15 business days of receiving all required materials from the Client.

• Revisions will be delivered within 10-15 business days after receiving feedback from the Client.

3. Hosting Services

Hosting Plan Overview

Bronze Plan – $79 AUD/month + GST

Ideal for simple websites or startups.

Includes:

• Free website build and design

• Up to 3 website pages

• 1 revision

• 1 email account

• 1 domain name

• 1 SSL certificate

• Daily backups

• Uptime monitoring

• Image and speed optimisation

• No lock-in contract

• 30-day money-back guarantee

Silver Plan – $99 AUD/month + GST

Best for growing businesses needing more flexibility.

Includes everything in Bronze, plus:

• Up to 5 website pages

• 2 revisions

• 3 email accounts

• Monthly maintenance

• Monthly reporting

Gold Plan – $199 AUD/month + GST

Best for established businesses seeking ongoing performance and support.

Includes everything in Silver, plus:

• Up to 10 website pages

• 3 revisions

• 10 email accounts

• Monthly growth session

• Google Analytics setup

• Google My Business setup

Other Terms (All Plans)

• Hosting support is provided during business hours (AEST).

• Issues caused by The Agency will be resolved within 48 hours of notification.

• The Agency is not responsible for changes made to the website by the Client.

• The Agency may charge for fixing issues caused by client modifications.

• Services may be updated or changed at any time based on evolving business needs.

4. Cancellation Policy

• All hosting plans can be cancelled with 30 days’ written notice.

• There are no fixed-term contracts.

• Monthly payments recur on the same date or closest available date, depending on bank processing.

• All prices exclude GST.

5. Support and Maintenance

• Hosting and technical support is available during business hours (AEST).

• Maintenance and reporting are available only on Silver and Gold plans.

• Any website downtime or technical issues due to Agency error will be resolved promptly.

• Fixes for client-caused issues may incur additional fees.

6. General Terms and Conditions

Acceptance of Agreement

By purchasing services, you agree to these Terms & Conditions under Australian law.

Payment Terms

The Client agrees to pay all fees as outlined in the selected plan. Payments are due monthly in advance and must be made via the agreed method.

Ownership of Work

All content, design, and code created by The Agency remain the property of The Agency unless otherwise agreed.

Client Obligations

The Client must provide all requested materials, approvals, and feedback on time. Delays may impact delivery timelines.

Intellectual Property

The Client confirms that any content provided does not infringe third-party intellectual property rights.

7. Limitation of Liability

Website Functionality and Performance

While all efforts will be made to deliver a fully functional website, The Agency is not liable for:

• Business losses from website errors or downtime

• Security breaches from third parties

• SEO ranking changes beyond our control

Content Liability

The Client is responsible for all published content. The Agency is not liable for:

• Legal consequences of client-provided content

• Infringement of copyright, trademarks, or compliance issues

Indemnification

The Client agrees to indemnify The Agency against any legal claims or costs from website use or content.

Third-Party Tools and Services

The Agency is not liable for third-party tools, services, or APIs used in the website.

Force Majeure

The Agency is not liable for service delays due to uncontrollable events (natural disasters, technical outages, etc.).

8. Termination

Either party may terminate with 30 days’ written notice. Hosting access will end unless otherwise negotiated.

9. Governing Law

This agreement is governed by the laws of Queensland, Australia. Disputes will be resolved accordingly.

10. Confidentiality

Both parties agree to keep any sensitive or proprietary information confidential.

11. Amendments

These T&C’s may only be amended by written agreement between both parties.
